PRIVACY POLICY

Destination Technologies, Inc. ("DTI") has adopted this Privacy Policy to inform its Subscribers how DTI collects, stores, and uses "Personal Information," as defined below. DTI and companies controlled by, under common control with, or controlling DTI, use Personal Information internally for controlling access to the DTI Service ("Service"), modifying the Service, developing enhancements to the Service, evaluating usage of the Service, and notifying Subscribers of changes to the Service. DTI's intent is to balance its legitimate business interests in collecting and using Personal Information against the reasonable expectations of privacy of the Subscribers. "Personal Information" includes, but is not limited to, name, address, telephone number, e-mail address, credit card information, data about individual usage of the Service, and similar information that personally identifies a given Subscriber. Personal Information is distinguished from "Directory Information". Certain information that would otherwise be Personal Information, such as name, address, telephone number, e-mail address, etc., is "Directory Information" when such information is provided by a Vendor or other Subscriber to DTI under a Service Usage Agreement for Vendors; such an agreement authorizes DTI to use and distribute Directory Information as part of the Service. A Service Usage Agreement for Planners does not authorize the collection or distribution of Directory Information. Directory Information, as distinct from Personal Information, is accessible to all Subscribers. If a Vendor or other Subscriber under a Service Usage Agreement for Vendors provides the same information as Personal Information and as Directory Information, such information is considered to be Directory Information. DTI is not liable for use of Directory Information made by Subscribers, including redistribution of Directory Information and sending of promotional messages using addresses in the Directory Information.

DTI does not disclose any Personal Information about any Subscriber to any third party without an express consent of such Subscriber. The Service does not include any functionality for performing "reverse searches" to identify Subscribers from items of Personal Information, such as e-mail addresses. DTI reserves the right to collect, analyze, and utilize Subscriber data in order to optimize the Subscriber experience, including the sharing of "Aggregate Subscriber Data" with DTI's contractors and marketing partners. "Aggregate Subscriber Data" means summaries of how Subscribers use the Service and Subscriber demographics. Aggregate Subscriber Data does not include information that personally identifies a given Subscriber, e.g., a Subscriber's name and address, or name and telephone number.

1. Collection
DTI collects Personal Information during e-mail and site registration, purchases, and other transactions between DTI and a given Subscriber. In addition, DTI collects Personal Information from Subscribers in the form of usage data (for example, length of session, pages viewed, navigation, etc.) for use as provided in paragraph 3 below.

2. Cookies
"Cookies" are pieces of information that DTI transfers to the hard drives of Subscribers for record-keeping purposes. DTI places Cookies with Subscribers to provide them with seamless access to the Service , since storing information in a Cookie eliminates the need to reenter that information on every page. The use of Cookies is an industry standard and occurs at most major Web sites.

3. Opt-In/Opt-Out
In the Account Maintenance area, each Subscriber can, at any time, Opt-in or Opt-out of the following:

  1. Promotional messages from DTI
  2. Promotional messages from Vendors
  3. Promotional messages from commercial partners of DTI
  4. Messages from other Subscribers other than Vendors, such as RFPs, RFQs.

New Subscribers are presented with a request to Opt-in or Opt-out as part of the subscription process. If a Subscriber makes no decision concerning Opting-in, the Subscriber is considered to have Opted-out. DTI does not sell, lease, or otherwise disclose to third parties mailing lists or telemarketing lists of its Subscribers. Promotional offers and related information will be sent only to Subscribers who have expressly "Opted-in" for a given type of message listed above.

4. Operational Data
DTI reserves the right to share data relating to network or software application performance ("Operational Data") with those companies providing software development, data processing, or network services to DTI. Operational Data may include Aggregate Subscriber Data, but such sharing of Operational Data shall not disclose the identity of Subscriber and has the objective of improving the Service.

5. Security Measures
DTI only collects Personal Information to the extent deemed reasonably necessary to serve its legitimate business purposes, and it uses state-of-the-art security technology to ensure the security, integrity, and privacy of all Personal Information. In addition, DTI uses security measures in connection with the collection and transmission of Personal Information during the registration process. DTI does not use "ghost GIFs".

6. DISCLAIMER CONCERNING CONTENT CONTROLS AND SECURITY LAPSES
DTI shall have no liability for the compliance of the content uploaded to the Service by Subscriber with any law, regulation, ordinance, treaty, contract, corporate policy, court order, or similar legal or regulatory instrument (collectively, "Content Controls"), including without limitation, whether such content is obscene, objectionable, accurate, misleading, has limits on to whom it may be disclosed, infringes the intellectual property rights of others, or is subject to export controls. DTI is not responsible for any breach of its security or for the actions of any third parties that may obtain any Personal Information. CLICKING ON ADVERTISEMENTS AND OTHER HYPERLINKS MAY LINK YOU TO THIRD PARTY WEBSITES IN WHICH DTI HAS NO CONTROL OVER CONTENT OR TRANSACTIONS; DTI EXPRESSLY DISCLAIMS ANY LIABILITY FOR VIRUSES, MONETARY LOSSES, HARMFUL COOKIES AND OTHER CONTENT, OR OTHER DAMAGES THAT MAY ARISE FROM LINKAGE TO SUCH THIRD PARTY WEBSITES.

7. Update of Personal Information
Subscribers may update their Personal Information or remove their Personal Information from the Opt-in distribution lists by visiting the Account Maintenance area of the Service or by any of the means listed below. Please be sure to include the following information in your correspondence using a means listed below:

  1. Your e-mail address
  2. Your Subscriber name (first and last name, or company name)
  3. The service type (Vendor or Planner)

8. Changes to Policy
DTI reserves the right to change this Privacy Policy at any time by notifying Subscribers (through posting a notice at this location or by e-mail) of the existence of a new Privacy Policy or any updates.

9. Ad Serving
This Web site may use the services of third parties for the serving and/or targeting of ads, promotions and other marketing messages. To do this, such parties collect and store anonymous data typically through the use of Cookies.
